District Justice Assaults Parent After Basketball Game

The Schuylkill League Basketball Playoffs are supposed to be intense, but this is just a tad too over the top. Following a hard fought boy’s championship game between North Schuylkill and Williams Valley on Friday night where one player was ejected and fans heckled the officiating crew for four full quarters, Magisterial District Justice David A. Plachko, a referee in the contest, reportedly attacked a Williams Valley parent outside of Martz Hall.

According to the victim and two eyewitnesses, Plachko allegedly threw Doug Thompson, owner of Thompson’s Service Station in Wiconsico, onto the hood of a parked vehicle and needed to be restrained by a fellow official. The SUV belonged to Pottsville Republican and Herald sports reporter, Dustin Haluska, which reportedly suffered a large dent.

“He slammed on the breaks of his car, jumped out, and came at me screaming profanities,” said Thompson, who admitted to shouting at Plachko as he drove by. “He then put his hands on me, threw me against a vehicle, and snarled ‘you Williams valley fans are all the same, you’re all nuts’. Thank goodness for the other referee who pealed him off of me.”

Thompson said that he did not realize that his attacker was a Schuylkill County magistrate. “It was only after someone said ‘I can’t believe a JP would act like that’ that I found out he was a district justice.”

After the altercation was broke up, Plachko reportedly drove away before police arrived. He was seen by Clarke Report sources at Club 18 shortly after the game. Pottsville Police Corporal Dennis Wiederhold, the investigating officer, arrived at the scene minutes later. After taking Thompson and other eyewitness statements, Plachko reportedly returned to the Martz Hall parking lot.

“Cpl. Wiederhold went over to his [Plachko’s] car, talked to him for a bit, and then came back over to me and said that ‘Judge Plachko wants to apologize and leave it at that,” Thompson stated. “But that was unacceptable to me. If I had done the same thing to him, I would be sitting in jail right now.”

Thompson said that he insisted that charges be filed. “I was contacted Sunday by the police, who said that they would be charging him with simple assault and harassment,” said Thompson.

Plachko, a Port Carbon democrat, will be seeking another term in office in November. He is the second Schuylkill County magistrate to find himself in legal trouble recently. Pottsville District Justice James K. Reiley was charged with two counts of DUI in September after he smashed into a parked vehicle and blew a .27% on a breathalyzer. Reiley was admitted to and completed an ARD program and was permitted to remain on the bench.

    That game was so crooked!! A person going to see a basketball game for the first time would have seen how lopsided that game was……its now time to look deeper and see how much these referees favor the Pottville area teams from where they are from year to year and how much they get paid off to do what they did on Friday night!!!!! As for the the player who got ejected from the game, give him a break!!! When you have the whole North Schuylkill student section calling your name and taunting you(even with there school admistration standing there approving it), players mugging you in the paint every play, there coach throwing his hands up in the air to the student section (thought he was MC Hammer) and the referees having it out for you, what else can you do. The referee was waiting all night just to make that call on him. They are kids and they will make mistakes, don’t we all.

    Thank you so much for reporting the whole story on this matter. My wife and I attended these games at Martz Hall on Friday 13, 2009. We stood and watched Nativity vs Tamaqua, congrats to Nativity on a very physical game. As we were standing, I heard fans from both Nativity and Tamaqua yelling at the Refs. The only difference was the Refs did their job and didn’t take it personal. Maybe Judge Plachko should take some lessons from them Referees. I would also like to congratulate North Schuylkill on a very, very physical win against Williams Valley. Thanks again for your time and your updated story.

    The bottom line is the kids, then the parents, then school administrators are responsible for how they act during a game. Kids will be kids but I’m willing to bet that the same parents that acted so immaturely are the parents of the kids acting the same way. Sportsmanship is a learned behavior…you figure out which parents and coaches teach it out of the Schuylkill League teams!

    As far as the Plachko incident; that will be dealt with sooner or later and whomever is at fault will get what’s coming to them. The fact of the matter is the refs didn’t lose that game for WV – WV lost the game specifically with a scoreless 3rd quarter! If you know and respect the game of basketball you will understand that refs can’t “lose” a game for an entire team. They can make crappy calls and maybe miss a foul but they can’t totally “lose” a game. If you disagree then you probably either never played the game at a highly competitive level.

    Skooker, obviously you are missing the point here, and you know nothing about the legal system or Schuylkill County politics. This “is not” about a basketball game, this is about a man who assaulted someone else. This is about a man who will “get off” because of who he knows. You can yell and scream at someone all you want,,,that does not give them the right to inflict pain on someone. Good thing there were eyewitnesses at the scene backing up this story. I do not care what Pottsville’s best decide to do, again I only hope the Voters see this guy for what he really is. And furthermore, I hope the PIAA does the right thing by getting rid of this guy.

  9. Skooker, obviously you are missing the point. I didn’t read any comments where anyone mentioned the refs lost the game for WV. The game was very physical and NS deserved to win the game after all, they are 3A they should’ve won. The fact of the matter is an elected official/piaa official is held to a higher standard and should have never entered into an altercation with a fan. You are correct in mentioning the responsibility of the students’ actions. They are just kids but unfortunately the taunting that one player in particular had to withstand was completely uncalled for. No player should have to play under those conditions especially a high school student.

This is ridiculous, Thompson obviously went looking for trouble but was too soft to react when he found it. WAAAAAAAAAAHHHHHHHHH I got pushed by the referee that I heckled all night when I confronted him in the parking lot.

    So this “victim” sought out the referee after the game by going to where the officials park, tried to engage him by admittedly screaming at him as he drove past, and then got thrown onto a car hood for his trouble. Wah wah wah! And now the only thing that matters to the author of this story is that it was Plachko? I applaud Plachko and I don’t care one bit if he is a DJ, a coal miner, or an unemployed schlep. Maybe next time the big mouth WV fan will think twice about what and to whom he yells.

    Last year ‘s 7th and 8th grade game at Pottsville was one of the worse games I ever seen reffed. I know even with two refs on the floor calls are going to be missed. It is a very hard job. I know I do it at the 2nd to 6th grade level every week. You can call a foul on either team every time they bring the ball up the floor. But when one team has 12 fouls and the other only has one at half there is something not right. These refs do favor Pottsville area teams(with the exception to MA). At half time I said to the one ref how can one team commit 12 and the other only 1 when both teams are playing like it is a hockey game. He just smiled and said he was doing his job. All anyone ask’s is you make the same call no matter the color of the teams jersey.

    we got the rope , we got the tree, all we need is a referee.

    Again , I say, You people do not know the law. It doesn’t matter what someone yells at you, you “CANNOT” lay your hands on them. It’s the Law!!! As far as what Plachko does, he took an oath, that has meaning, you wouldn’t know that cause you live in your own little world. Whatever it was, the fact that Plachko chose to confront this guy will no doubt get him in a jam, but let’s not excuse the bozo who prompted this encounter. Plachko should get a Harassment for the push and the WV should get a Disorderly Conduct for prompting the encounter. End of story. (and that is the law George!)

The law states, “you must remove yourself from the situation and notify authorities”. He was yelled at through a closed window in a car.     George, it was me, not G, who challenged your view on the “law.” And if you are the “law” in this county, then you should know that it’s spelled Plachko, not Platchko. And if you read my post, I believe I provided you what would happen to both parties. This was not a “Simple Assault,” it was a “Harassment,” which if you are actually knowledgeable about the law, you would know is a Summary offense and wouldn’t warrant being “hauled away in cuffs.” They should/could each get a NTC for their roles in the incident or they could shake hands and be done with it.

    George, please. Read my post(s) again. Did I say anywhere that Plachko was correct in what he did?? And yes, I do know the definition of assault. And I also know the definition of Harassment and I do know that even if Plachko is ‘charged’ with Simple Assault and Harassment, it will be dropped to just Harassment at the preliminary hearing, just like 99.9% of cases like this are. If you have a personal beef with Plachko that’s clouding your opinion then you should put that aside when discussing the law, but you should know that, right?

    I do not want another DJ to get preferential treatment. How can someone sit and rule on people of his area, when he has done things like this himself. Just like Reilly, who remains on the bench. That is just wrong. Reilly is going to hand down verdicts on DUI cases when he himself was charged with 2 counts of DUI. It’s just not right. I’m tired of people like this not receiving a fair sentence. Therefore the only recourse people have is to use the instruments availbale to them. In this case, we have two choices. The voters can vote him out because of the person he is. And they can use outlets like this to voice their opinion, just like you and I are doing here.

    From the law enforcement perspective, no, Plachko shouldn’t have engaged this parent, and I’ve said that more than once. But just as Plachko should have kept his cool, the WV parent prompted the incident and should also be held accountable.

    I agree that no preferential treatment should be shown, but I also don’t think Plachko should be treated in the criminal court any differently than you or I would. They both get charged with summaries and it’s over. As for the handshake, it was an alternative to charging both parties…and it happens all the time.

    What the President Judge then decides for him, that’s his call.

    As for DJ Reilly, who is a good, good man, he insisted on being arrested for his DUI crash. He’s taking his punishment just like anyone else and fyi, he’s not hearing DUI cases specifically because of his case.

    The Fact is we the people of Schuylkill County, Republican or Democrat need to demand more from our public servants.

    If the fan was out of order, i.e. making threats to the ref, that should come with charges too. But nothing gives the right for this Judge to physically assault anyone.

    Not only should he be removed from the bench when found guilty / or plead guilty, he should be barred from running for office again. EVER. He should be barred from Reffing any sport as well.

    As for the Pottsville “News Paper” well again they have shown they cannot be unbiased. Another in a long line of media outlets who will go to any lenghts to protect a democrat.

    I wish I would have gotten on here earlier. The report that was posted was sooooo blown up. DP did not jump out of his car after the parent. The parent approached the car with his fist cocked and DP opened the door to push him back. That is how it started. As for the fight with his brother, not true again. DP never left his car. His brother got into a fight with a scumbag that hit him with a bottle because of some words being exchanged. Neither were arrested. No charges were ever filed. This goes again to show that the Pottsville REPUBLICAN is biased. Two incidents, both blown out of proportion and they make the front page and make him out to be the bad guy. If Dave Argall were to punch a little old lady in the face, that wouldn’t even be reported. Lastly, I have seen this guy as a ref and I would put him in one of the top 2 or 3 in the area. He even does games at the college level. You can’t get there by being crooked.

    You are demanding “harsher” charges against Plachko…what types of charges would you like to see imposed to put him in jail?? This incident was nothing more than a minor physical altercation and was never a situation where ANYONE would go to jail. To suggest otherwise displays your ignorance about the incident as well as Pennsylvania law.

    And as for losing his job, and never to be able to run for office again, I’m curious as to what your thinking is on this and whether you’d apply the same standard to yourself if you had been in a similar situation.

    This was a momentary lapse in judgment on the part of two adults, not the crime of the century.

    No it is not the crime of the century but it is a crime.

    I happen to know a bit more about Pennsylvania Law that you seem to, in this instance simple assault carries up to 2 years in prison in Pennsylvania, and can be carried to a longer sentance due to secondary charges, ie property damage (a car was damaged was it not).

    Simple Assault is usually a Misdemeanor 2 charge, unless it is an assault by an adult on a child under 12, in which case it is a more serious Misdemeanor 1. If it is a fight where both parties enter by mutual consent, it is a Misdemeanor 3 charge. EVEN if you were a good lawyer (which you are obviously not) you would push for Misdemeanor 3 and argue they were both fighting, that would still carry up to 1 year in jail.

    You assume that I would allow myself to get into that situation.
    Putting aside the fact that I am not stupid enough to do that, IF I were an elected offical, and were stupid enough to fall into this situation, yes… I should not be allowed to sit on a bench and judge others. Thats a fact. But you do not seem to be intrested in those (facts). You would rather name call.

    While I find it a humorous that you “happen to know a bit more about Pennsylvania Law” than I do, I won’t waste my time debating my credentials with you; I’ll just discuss your analysis. A Simple Assault charge would never be supported unless there was bodily injury, and bruising and/or minor abrasions don’t count…period. EVEN if I was a lawyer, good or bad, I could get the Simple Assault thrown out at the preliminary hearing. So like I’ve said here previously, at most, what you have here is a summary harassment for the push by Plachko.

    Your claim that you should lose your job if you were “stupid enough to fall into this situation” is noble, but you should save your certainty until you’re faced with such a reality.

    Finally, as if it matters, I’m a registered Republican and for the life of me, I can’t figure out where I called you any name other than “Taxpayer M.” Do tell.

    Judge Plachko did not. I have faced this reality EVERY day since I began my current profession of 20 years. And not once have I made the choice Judge Plachko did. Speaks volumes not only about me, but about the good District Justice you are defending so adamantly.

    He is not fit to sit in judgment of others. He is an embarrassment to the County, shame on him and any one who would defend his behavior.

    I guess you would have to wonder how exactly he made this go away. He has already shown he believes himself beyond conduct that would be expected of anyone else. I wonder if he would stoop to the level of using his office to pressure this man to drop these charges. Just a thought, of course that to you would be ok. Right.     Taxpayer M, you could not be more wrong. You ABSOLUTELY could not be more wrong. You are wrong about the definitions of assault as well as how they are prosecuted by the courts. You should stop trying to be smarter than you are.

    As for Plachko, I am not defending him, but merely pointing the reality of the situation. This was not, by definition, Simple Assault, and that’s all I’m saying.

    I have know idea where you found your definition of Simple Assault, but it’s nowhere near the PA Crimes Code definiton. Your Agg Assault definition is better, but is only one part of the actual definition. Now, so you don’t have google for anymore versions, I’ll make it simple for you:

    In the real world, or at least in Schuylkill county, this is how things play out:

    I punch you in the mouth causing minor bruising and/or swelling. That’s a summary Harassment.

    I punch you in the face breaking your nose. That’s Simple Assault.

    I punch you in the face several times breaking your nose, your jaw and subsequently knocking you to the ground causing you to fracture your skull. That’s Agg Assault.

    Now you don’t have to like these real world definitions, but this is reality. Now knowing this, where does Plachko’s push fall into these categories??

    1) attempts to cause or intentionally, knowingly or recklessly causes bodily injury to another.

    What your trying to push off as law is, 18 Pa.C.S. § 2701(a)(1) which refers to bodily injury, and is accurate, how ever, I am not required inflict Bodily injury only ATTEMPT to cause.

    I was looking for the Elected Schuylkill County Democrat exemption but could not find it.

    I am not defending Plachko and I never said he shouldn’t be arrested for his actions. What I said was that he should be arrested for the same thing you or I would have been arrested for when doing the same thing, and that is Harassment.

    I am not trying to “push off as law” my explanation of Harassment…it is the law. And that’s exactly what Plachko did…he shoved the guy or otherwise subjected him to physical contact.

    Could he have been CHARGED with Simple Assault and Harassment? Yes, and I’ve said that previously, but the Simple Assault charge would have never gotten past the preliminary hearing stage. It would’ve been dropped given these circumstances, just like it would have been for you or I, and then he would only have had to deal with the summary Harassment charge.

    Taxpayer M, I’m not sure what you’re not understanding, but I can’t be any clearer than that.

    Also not true….I know the what the definitions say but I gave you the real world applications of the various levels of assault. And they’re applied that way in many counties, including here in Schuylkill county. Feel free to sit at one of the DJ’s offices some day and find out for yourself. If you don’t have the time, then ask any attorney, or any judge, or any cop friend of yours if what I am saying isn’t true.

    Otherwise, we’ll just have to agree to disagree.

    A 52-year-old Pine Grove man was aressted by state police at Jonestown and charged with simple assault and harrassment after an incident at Fisher Avenue and Micro Drive in Union Township Lebanon county, at 5 p.m.

    Troopers said Clarence Tobin Jr. will have to answer to the charge in a Lebanon district court.

    Troopers charge Tobin with grabbing, and hitting Gail Madenford, 45, of Jonestown, causing the woman to suffer some bruising.

    **As long as this wasn’t a domestic violence incident, this is a perfect scenario…follow this case and I guarantee he only pleads or is found guilty of Harassment. (Unless of course she decides that she still loves him and drops the charges all together!)

    **Tricky question only because of your scenario.. if you went after Plachko in his role as a ref, Assault on a Sports Official is a misdemeanor and would’ve had to have been witnessed by the police. If you went after him in his role as a judge, that’s Agg Assault and you go away in cuffs.

    **Read my previous posts, I’ve said that the whole time. Plachko was wrong, I absolutely agree with you. I’ve said over and over, Plachko could have been charged with both Simple and Harassment. But given the minor nature of the “assault,” only the Harassment would have stuck.

    **And if the WV parent would’ve pursued it, Plachko probably would have been convicted of Harassment. The decision the WV parent had to make was whether pursuing it was worth a possible Disorderly Conduct conviction for himself.
