District Justice Assaults Parent After Basketball Game

The Schuylkill League Basketball Playoffs are supposed to be intense, but this is just a tad too over the top. Following a hard fought boy’s championship game between North Schuylkill and Williams Valley on Friday night where one player was ejected and fans heckled the officiating crew for four full quarters, Magisterial District Justice David A. Plachko, a referee in the contest, reportedly attacked a Williams Valley parent outside of Martz Hall.

According to the victim and two eyewitnesses, Plachko allegedly threw Doug Thompson, owner of Thompson’s Service Station in Wiconsico, onto the hood of a parked vehicle and needed to be restrained by a fellow official. The SUV belonged to Pottsville Republican and Herald sports reporter, Dustin Haluska, which reportedly suffered a large dent.

“He slammed on the breaks of his car, jumped out, and came at me screaming profanities,” said Thompson, who admitted to shouting at Plachko as he drove by. “He then put his hands on me, threw me against a vehicle, and snarled ‘you Williams valley fans are all the same, you’re all nuts’. Thank goodness for the other referee who pealed him off of me.”

Thompson said that he did not realize that his attacker was a Schuylkill County magistrate. “It was only after someone said ‘I can’t believe a JP would act like that’ that I found out he was a district justice.”

After the altercation was broke up, Plachko reportedly drove away before police arrived. He was seen by Clarke Report sources at Club 18 shortly after the game. Pottsville Police Corporal Dennis Wiederhold, the investigating officer, arrived at the scene minutes later. After taking Thompson and other eyewitness statements, Plachko reportedly returned to the Martz Hall parking lot.

“Cpl. Wiederhold went over to his [Plachko’s] car, talked to him for a bit, and then came back over to me and said that ‘Judge Plachko wants to apologize and leave it at that,” Thompson stated. “But that was unacceptable to me. If I had done the same thing to him, I would be sitting in jail right now.”

Thompson said that he insisted that charges be filed. “I was contacted Sunday by the police, who said that they would be charging him with simple assault and harassment,” said Thompson.

Plachko, a Port Carbon democrat, will be seeking another term in office in November. He is the second Schuylkill County magistrate to find himself in legal trouble recently. Pottsville District Justice James K. Reiley was charged with two counts of DUI in September after he smashed into a parked vehicle and blew a .27% on a breathalyzer. Reiley was admitted to and completed an ARD program and was permitted to remain on the bench.

That game was so crooked!! A person going to see a basketball game for the first time would have seen how lopsided that game was……its now time to look deeper and see how much these referees favor the Pottville area teams from where they are from year to year and how much they get paid off to do what they did on Friday night!!!!! As for the the player who got ejected from the game, give him a break!!! When you have the whole North Schuylkill student section calling your name and taunting you(even with there school admistration standing there approving it), players mugging you in the paint every play, there coach throwing his hands up in the air to the student section (thought he was MC Hammer) and the referees having it out for you, what else can you do. The referee was waiting all night just to make that call on him. They are kids and they will make mistakes, don’t we all.

  3. George

I cannot believe they would allow a man like this to remain on the bench. And furthermore, I hope the PIAA gets rid of this guy. Geez, our kids aren’t safe out there with a guy like this.

  4. Warren Swartzlander

Thank you so much for reporting the whole story on this matter. My wife and I attended these games at Martz Hall on Friday 13, 2009. We stood and watched Nativity vs Tamaqua, congrats to Nativity on a very physical game. As we were standing, I heard fans from both Nativity and Tamaqua yelling at the Refs. The only difference was the Refs did their job and didn’t take it personal. Maybe Judge Plachko should take some lessons from them Referees. I would also like to congratulate North Schuylkill on a very, very physical win against Williams Valley. Thanks again for your time and your updated story.

  5. George

I certainly hope the voters of Port Carbon oust this guy. How fair can he possibly be when he does stuff like this??

  6. Skooker

The bottom line is the kids, then the parents, then school administrators are responsible for how they act during a game. Kids will be kids but I’m willing to bet that the same parents that acted so immaturely are the parents of the kids acting the same way. Sportsmanship is a learned behavior…you figure out which parents and coaches teach it out of the Schuylkill League teams!

As far as the Plachko incident; that will be dealt with sooner or later and whomever is at fault will get what’s coming to them. The fact of the matter is the refs didn’t lose that game for WV – WV lost the game specifically with a scoreless 3rd quarter! If you know and respect the game of basketball you will understand that refs can’t “lose” a game for an entire team. They can make crappy calls and maybe miss a foul but they can’t totally “lose” a game. If you disagree then you probably either never played the game at a highly competitive level.

  7. Jane S.

What do you expect from a Democrat?

  8. George

Skooker, obviously you are missing the point here, and you know nothing about the legal system or Schuylkill County politics. This “is not” about a basketball game, this is about a man who assaulted someone else. This is about a man who will “get off” because of who he knows. You can yell and scream at someone all you want,,,that does not give them the right to inflict pain on someone. Good thing there were eyewitnesses at the scene backing up this story. I do not care what Pottsville’s best decide to do, again I only hope the Voters see this guy for what he really is. And furthermore, I hope the PIAA does the right thing by getting rid of this guy.

  9. Skooker, obviously you are missing the point. I didn’t read any comments where anyone mentioned the refs lost the game for WV. The game was very physical and NS deserved to win the game after all, they are 3A they should’ve won. The fact of the matter is an elected official/piaa official is held to a higher standard and should have never entered into an altercation with a fan. You are correct in mentioning the responsibility of the students’ actions. They are just kids but unfortunately the taunting that one player in particular had to withstand was completely uncalled for. No player should have to play under those conditions especially a high school student.

  10. me2020

The Pottsville newspaper must be trying to cover it up already.First they had it as BREAKING NEWS with 4 comments posted (that’s where I found out about this site,) now if you check it, there are no comments posted at all.
I guess it’s who you know around here. What a shame!

  11. G

this is obviously a crock……there is no way this happened. He would never lost control like this. My guess is the parent saw the parking lot sign that says “officials parking” and waited for him.

  12. Voter

Your right George. I hope the voters really see Plachko’s true colors. He sentences people for crimes that he himself commits. Vote Leonard C. Gravish for District Justice May 19.

  13. T

Something about this story doesn’t add up. If he was mad enough to get out of his car, grab the guy and slam him into a parked car why would he only say what he did? Plus he is a very mild mannered man. I agree with G.

  14. Does anybody remember Plachko and his brother being arrested after a bar fight a few years back. He got off then too. You gotta love Schuylkill County “politics”.

  15. Beansie

Jane S, you are quite obviously a clown. “What do you expect from a Democrat”. After 8 of the WORST years in our Nation’s history, where the Republican party essentially broke the world, you take a pot shot at the Democrats because some loudmouth, classless Williams Valley fan got the comeuppance that we all know he so richly deserved. This is ridiculous, Thompson obviously went looking for trouble but was too soft to react when he found it. WAAAAAAAAAAHHHHHHHHH I got pushed by the referee that I heckled all night when I confronted him in the parking lot.

  16. F

So this “victim” sought out the referee after the game by going to where the officials park, tried to engage him by admittedly screaming at him as he drove past, and then got thrown onto a car hood for his trouble. Wah wah wah! And now the only thing that matters to the author of this story is that it was Plachko? I applaud Plachko and I don’t care one bit if he is a DJ, a coal miner, or an unemployed schlep. Maybe next time the big mouth WV fan will think twice about what and to whom he yells.

  17. Mahanoy Area

Last year ‘s 7th and 8th grade game at Pottsville was one of the worse games I ever seen reffed. I know even with two refs on the floor calls are going to be missed. It is a very hard job. I know I do it at the 2nd to 6th grade level every week. You can call a foul on either team every time they bring the ball up the floor. But when one team has 12 fouls and the other only has one at half there is something not right. These refs do favor Pottsville area teams(with the exception to MA). At half time I said to the one ref how can one team commit 12 and the other only 1 when both teams are playing like it is a hockey game. He just smiled and said he was doing his job. All anyone ask’s is you make the same call no matter the color of the teams jersey.

we got the rope , we got the tree, all we need is a referee.

  18. George

Again , I say, You people do not know the law. It doesn’t matter what someone yells at you, you “CANNOT” lay your hands on them. It’s the Law!!! As far as what Plachko does, he took an oath, that has meaning, you wouldn’t know that cause you live in your own little world. Someone doing his job, sentencing people for doing exactly what he just did, “Cannot” act out in this manor.
This will hurt him, guaranteed, and I’m glad it will.
I don’t care what party affiliation he is,,,I just hope he gets voted out. And for your information, Mr. Thompsom was loading the coolers into the bus after the game, he “WAS NOT” waiting for anyone.
Again, Good thing their were eyewitnesses. As far as Thompson not doing anything, He did the right thing, that is why Plachko will get charged with Assault today——YES YES YES

  19. George

I’ve seen it all now. The “Republican” is blocking all posts pertaining to the Plachko article. What a cover up,,,,good thing we have the Clarke Report.
They will make this go away one way or another.
Guess what I won’t let it go away. Politicians always get off when they do something,,,but the common guy who makes a mistake gets hammered. I’ll bet if it were Thompson who grabbed Plachko he would have been hauled off in cuff’s. I hope I can find out who is running agaisn’t this guy,,,I want to help them financially as well as get the word out. Plachko will not get re-elected on my watch.!!

  20. BE

It will not get blocked, the article has just been forwarded to the PIAA and the Harrisburg Patriot.
    hahaha

  21. George

    Already Done BE

  22. BE

Well they will get it twice then G!! Way to go

  23. new skook

    TO Old Skook:

I remember that bar fight incident. As I recall, it was a similar situation where Dave Plachko jumped out of his car and got into a brawl on progress avenue.

  24. BE

Williams Valley is having there annual Professional Wrestling event again this year which is coming up soon.

Mr. Plachko, you can come and be the special referee. You will fit right in…….hahaha

  25. G

    you people need a life!!!!!!
THIS will not hurt him. He’ll STILL get 80% of the vote. He would have run away w/ the Senate race had he won. The parent was out of control. George: you’re wrong if you feel some AGGRESSIVE person is invading your space & you feel threatened you CAN defend yourself. WHY would you forward this story to the PIAA? You take joy in the art of trying to cause trouble for others. Stand tall Plach-you’ll be fine!

  26. George

Again you do not know the law,,,,you must flee and evade if at all possible, He was inside his car, he could have kept going. He chose to stop and confront this guy. learn the law before you run your mouth.

  27. BE

Why would we not forward the story to the PIAA. His actions were out of line in what he did. Why should the PIAA not know about it about G? We could get really into this further. He was seen at Club 18 in Pottsville after the game/incident, then drove back to the scene. Hmmmmmmmm. Wonder what he was drinking befor he got back into his car. We can push this as far and as long as we want G. The bottom line he was wrong in what he did and you know it.

  28. George

I have heard that Plachko has already resigned from the PIAA,, hmm…..admitting guilt??

  29. G

Did you see him in Club 18?????
George: you are a hater and don’t deserve to have such a great name. Who told you he resigned from the PIAA? Would you blame any of these refs if they did? They make about 20.00 per hour (which probably makes your mouth water) to get abused by inbreds and idiots. They then try to leave the game and get verbally abused.
Again, in any election bid he would smash ANY opponent. Run against him and see if I’m right.

Give the guy a break. SOMEDAY you may need a break. Karma rules

  30. BE

GREAT NEWS!!!! Channel 21 out of Harrisburg reported the incident on the morning news today and mentioned Mr. Plachko. WOW. I would be sweating bullets!!!!!!!!

  31. F

George and BE, you sound like you really have a thing for Plachko!?! Regarding the incident, Plachko probably should’ve just kept driving, but we don’t know what exactly was said by this parent. Whatever it was, the fact that Plachko chose to confront this guy will no doubt get him in a jam, but let’s not excuse the bozo who prompted this encounter. Plachko should get a Harassment for the push and the WV should get a Disorderly Conduct for prompting the encounter. End of story. (and that is the law George!)

  32. G

    Be:

FYI it is NOT there annual wrestling….it IS their annual wrestling. Should be a basic skills test and/or verification of intellect in order to post an ANONYMOUS post. Was going to give you a pass until you proclaimed GOOD NEWS. How is this GOOD NEWS? You feel it is GOOD NEWS to try to slam a good man? I’m sure you would feel better about yourself if you had a decent job, a loving family, hobbies or people that look up to you. You are a miserable person. Anonymity does not mean courage!

  33. George

G, for your information, I am the law. Platchko will get it for Assault. At the most the fan will get harrassment. I will say again, you “cannot” grab someone and assault them for any reason. The law states, “you must remove yourself from the situation and notify authorities”. He was yelled at through a closed window in a car. He “Chose” to get out of his car and inflict “pain” to another individual. Can you say lawsuit. Know the law.

  34. George

F, I’ll help you also. You “cannot” assault someone for any reason. If he was disturbed by what was yelled at him his “only” choose was to call the authorities. For the last time,,,,you “cannot” assault someone for yelling something at you.

  35. BE

I do have a good job probably alot more than you make, a great and loving family that i would die for and hobbies that you could only imagine my friend. What’s your deal anyway? I know.

G are you Plachko’s DADDY!!!!!!!! Come up for air and get your head our of his ——-!!!

  36. George

“Be” We can let this alone. I just got a call. bad news for Plachko.

  37. F

George, it was me, not G, who challenged your view on the “law.” And if you are the “law” in this county, then you should know that it’s spelled Plachko, not Platchko. And if you read my post, I believe I provided you what would happen to both parties. This was not a “Simple Assault,” it was a “Harassment,” which if you are actually knowledgeable about the law, you would know is a Summary offense and wouldn’t warrant being “hauled away in cuffs.” They should/could each get a NTC for their roles in the incident or they could shake hands and be done with it.

  38. George

    PIAA is all over it!!

  39. George

Shaking hands is exactly what Plachko wanted from the very beginning. I wonder why?? Who do you think has more to lose in this deal?? By the way, excuse my mispelling. I am not the Law anywhere near Schuylkill county, nor would I want to be. I have moved out of the area, and I do know the law. Let’s wait and see what comes out of today’s Press Conference shall we?? I’m sure the witnesses provided will give a detailed story on what took place. Thank God they were there.
Do you agree you “Cannot” Assault someone for yellng through a car window at you??? Do you know the definition of assault?? I was willing to let this go,,I believe I will. It will play out the way it plays out no matter what “opinion” you and I hold. I cannot believe that people do not understand, that by someone yelling at you, you have the right to assault them. I don’t get it!!!

  40. George

Assault and Battery: An “illegal” Act in which a threat of attack on another person is carried out.

Assault: A “Violent” “Illegal” “Physical” act .

  41. F

George, please. Read my post(s) again. Did I say anywhere that Plachko was correct in what he did?? And yes, I do know the definition of assault. And I also know the definition of Harassment and I do know that even if Plachko is ‘charged’ with Simple Assault and Harassment, it will be dropped to just Harassment at the preliminary hearing, just like 99.9% of cases like this are. If you have a personal beef with Plachko that’s clouding your opinion then you should put that aside when discussing the law, but you should know that, right?

  42. George

Agreed F. Only thing is, and I think you will agree. This should be moved someplace else to be heard.
I do not want another DJ to get preferential treatment. How can someone sit and rule on people of his area, when he has done things like this himself. Just like Reilly, who remains on the bench. That is just wrong. Reilly is going to hand down verdicts on DUI cases when he himself was charged with 2 counts of DUI. It’s just not right. I’m tired of people like this not receiving a fair sentence. Therefore the only recourse people have is to use the instruments availbale to them. In this case, we have two choices. The voters can vote him out because of the person he is. And they can use outlets like this to voice their opinion, just like you and I are doing here.

No I did not say you did. I’m asking you do you agree you cannot assault someone for yelling at you through a closed window of a car??

    Your Answer???

I draw tired of this stuff. Bottom line, he did wrong and he should pay the price the same as anyone else. Not a handshake.

  43. F

From the law enforcement perspective, no, Plachko shouldn’t have engaged this parent, and I’ve said that more than once. But just as Plachko should have kept his cool, the WV parent prompted the incident and should also be held accountable.

I agree that no preferential treatment should be shown, but I also don’t think Plachko should be treated in the criminal court any differently than you or I would. They both get charged with summaries and it’s over. As for the handshake, it was an alternative to charging both parties…and it happens all the time.

What the President Judge then decides for him, that’s his call.

As for DJ Reilly, who is a good, good man, he insisted on being arrested for his DUI crash. He’s taking his punishment just like anyone else and fyi, he’s not hearing DUI cases specifically because of his case.

  44. to Jane S.

Wow – you have the nerve to say what do you expect from a democrat. How about our last president – a republican who sent innocent men and women who are fathers, mothers, brothers, sisters, etc to die in a war that was not ours to fight. Now he is an idiot.

  45. PO

This is only a big deal because of what this guy does for a living. Had it been anyone else it wouldn’t even be an issue. That idiot waited for Plachko and instigated the whole thing!! I hope he will be charged with harassment!! Plachko is a good guy. Leave him alone!!!!!!!!!!!!!!!!!!!!!!

  46. G

I am not related to him. Just a friend that understands how badly it sucks when anonymous idiots get on the attack. Idiots LIKE YOU, George. Nothing to gain from this BUT you spend time today posting 12 messages in a little more than 3 hours. A lot of free time for a “law man”. Where do you work, Mayberry RFD?
Get outside and check on the things….your house looks a little low on air in the back tire.

  47. George

    Bottom Line!!! It’s being investigated!!
    Mission Accomplished!!

  48. George

F, Thanks for keeping straight on the Reilly case.

Not 100% satisfied he remained on the bench though.

  49. Jane S.

I’ve said it before, and I’ll say it again. What do you expect from a Democrat. That’s what they do when confronted by someone with an opposing view. They attack. Simply put, in my opinion Schuylkill County Democrats are; Low-class, beer swilling, union loving, bar fighting, red neck underachievers. Now prove me wrong with your comments:)

  50. to Jane S.

You are the kind of person that has no friends and whose family cannot even stand being around you. You probably wear a KKK outfit and hate anyone who is not a white republican. I am a republican married to a schuylkill county man who is a democrat…he has his masters in social work, has a great job (NOT in a union), he will have a drink or two if we go out which is not often because we have 3 small children….SO THERE – PROVED YOU WRONG. People like YOU are redneck, low class people.

  51. I support Plachko

I will vote for Plachko in November. That parent got what he deserved. I would have done the same thing. Parents can get totally out of hand at sporting events. Don’t they realize, in sports and competitions, there is always a winner and a LOSER! Teach your children what competing is all about don’t provoke the opposition.

  52. G

George has gotten awfully quiet aince the following happened:
    A) no charges will be filed.
    B) DP did not resign from officiating.

Go back in your hole and be alone

  53. Missy

Does Jane S really have to be so nasty and mean spirited? How does this help anyone? It’s just pathetic.

  54. It should not matter if this guy is a DJ or not, he should be in jail, and the charges should be much harsher and include property damage charges, and disorderly conduct.

The Fact is we the people of Schuylkill County, Republican or Democrat need to demand more from our public servants.

If the fan was out of order, i.e. making threats to the ref, that should come with charges too. But nothing gives the right for this Judge to physically assault anyone.

Not only should he be removed from the bench when found guilty / or plead guilty, he should be barred from running for office again. EVER. He should be barred from Reffing any sport as well.

As for the Pottsville “News Paper” well again they have shown they cannot be unbiased. Another in a long line of media outlets who will go to any lenghts to protect a democrat.

  55. The Chairman

I wish I would have gotten on here earlier. The report that was posted was sooooo blown up. DP did not jump out of his car after the parent. The parent approached the car with his fist cocked and DP opened the door to push him back. That is how it started. As for the fight with his brother, not true again. DP never left his car. His brother got into a fight with a scumbag that hit him with a bottle because of some words being exchanged. Neither were arrested. No charges were ever filed. This goes again to show that the Pottsville REPUBLICAN is biased. Two incidents, both blown out of proportion and they make the front page and make him out to be the bad guy. If Dave Argall were to punch a little old lady in the face, that wouldn’t even be reported. Lastly, I have seen this guy as a ref and I would put him in one of the top 2 or 3 in the area. He even does games at the college level. You can’t get there by being crooked.

  56. F

    Taxpayer M:

You are demanding “harsher” charges against Plachko…what types of charges would you like to see imposed to put him in jail?? This incident was nothing more than a minor physical altercation and was never a situation where ANYONE would go to jail. To suggest otherwise displays your ignorance about the incident as well as Pennsylvania law.

And as for losing his job, and never to be able to run for office again, I’m curious as to what your thinking is on this and whether you’d apply the same standard to yourself if you had been in a similar situation.

This was a momentary lapse in judgment on the part of two adults, not the crime of the century.

    Give it a rest.

  57. F,
I do not remember DEMANDING anything, just saying in my opinion the police already attempted to assisted him in putting it under the rug.
No it is not the crime of the century but it is a crime.

I happen to know a bit more about Pennsylvania Law that you seem to, in this instance simple assault carries up to 2 years in prison in Pennsylvania, and can be carried to a longer sentance due to secondary charges, ie property damage (a car was damaged was it not).

Simple Assault is usually a Misdemeanor 2 charge, unless it is an assault by an adult on a child under 12, in which case it is a more serious Misdemeanor 1. If it is a fight where both parties enter by mutual consent, it is a Misdemeanor 3 charge. EVEN if you were a good lawyer (which you are obviously not) you would push for Misdemeanor 3 and argue they were both fighting, that would still carry up to 1 year in jail.

You assume that I would allow myself to get into that situation.
Putting aside the fact that I am not stupid enough to do that, IF I were an elected offical, and were stupid enough to fall into this situation, yes… I should not be allowed to sit on a bench and judge others. Thats a fact. But you do not seem to be intrested in those (facts). You would rather name call.

    You must be a democrat.

  58. F

    Taxpayer M,

You said, “I do not remember DEMANDING anything, just saying in my opinion the police already attempted to assisted him in putting it under the rug.” However in your 6:54 am post, you clearly say, “…he should be in jail, and the charges should be much harsher and include property damage charges, and disorderly conduct.”
    So am I missing something??

While I find it a humorous that you “happen to know a bit more about Pennsylvania Law” than I do, I won’t waste my time debating my credentials with you; I’ll just discuss your analysis. A Simple Assault charge would never be supported unless there was bodily injury, and bruising and/or minor abrasions don’t count…period. EVEN if I was a lawyer, good or bad, I could get the Simple Assault thrown out at the preliminary hearing. So like I’ve said here previously, at most, what you have here is a summary harassment for the push by Plachko.

Your claim that you should lose your job if you were “stupid enough to fall into this situation” is noble, but you should save your certainty until you’re faced with such a reality.

Finally, as if it matters, I’m a registered Republican and for the life of me, I can’t figure out where I called you any name other than “Taxpayer M.” Do tell.

  59. You call that a demand? It is my opinion. Far from a demand. I am in no position to demand anything of anyone. This is just a sounding board, right.

Or are the powers that be going to read this and say, Taxpayer M said he sould be in jail well we better go put him in custody?

Simple assault does not require injury, no matter how you attempt to twist the law to prove your point. Simple assault only requires that some sort of contact be made, it can be throwing an orange at a bag boy, or pushing a moron who is trying to confront you. Only Aggravated assault requires injuries.

Every day, I am faced with choices. Every day I make the ones that I believe are correct.
Judge Plachko did not. I have faced this reality EVERY day since I began my current profession of 20 years. And not once have I made the choice Judge Plachko did. Speaks volumes not only about me, but about the good District Justice you are defending so adamantly.

He is not fit to sit in judgment of others. He is an embarrassment to the County, shame on him and any one who would defend his behavior.

I guess you would have to wonder how exactly he made this go away. He has already shown he believes himself beyond conduct that would be expected of anyone else. I wonder if he would stoop to the level of using his office to pressure this man to drop these charges. Just a thought, of course that to you would be ok. Right. Be a good Democrat and make some more excuses for this DJ’s pitiful behavior.

  60. I would think being called Ignorant, rather than Taxpayer M, would constitute Name calling.

You sound as much like a republican as Arlen Specter.

  61. F

You said, “Simple assault does not require injury, no matter how you attempt to twist the law to prove your point. Simple assault only requires that some sort of contact be made, it can be throwing an orange at a bag boy, or pushing a moron who is trying to confront you. Only Aggravated assault requires injuries.”

Taxpayer M, you could not be more wrong. You ABSOLUTELY could not be more wrong. You are wrong about the definitions of assault as well as how they are prosecuted by the courts. You should stop trying to be smarter than you are.

As for Plachko, I am not defending him, but merely pointing the reality of the situation. This was not, by definition, Simple Assault, and that’s all I’m saying.

Now go back to my original response to you… I said, “To suggest otherwise displays your ignorance about the incident as well as Pennsylvania law.” As you can see, I never called you “ignorant.” I’ve tried to conduct our discussion like an adult while you have resorted to juvenile remarks (“you must be a democrat!”) all the while patting yourself on the back about your “correct” decision making ability. And that Taxpayer M, “speaks volumes” about you.

  62. Define Simple Assault – Assaults which are limited to the use of physical force and result in little or no injury to the victim,
An unlawful physical attack by one person upon another where neither the offender displays a weapon, nor the victim suffers obvious severe or aggravated bodily injury involving apparent broken bones, loss of teeth, possible internal injury, severe laceration, or loss of consciousness.

Define aggravated assault – An attempt to cause serious bodily injury to another or purposely, knowingly or recklessly causing such injury, or an attempt to cause or purposely or knowingly cause bodily injury to another with a deadly weapon.

Um.. ya.. I am right. Therefore for not ignorant as you suggested.

  63. F

I have know idea where you found your definition of Simple Assault, but it’s nowhere near the PA Crimes Code definiton. Your Agg Assault definition is better, but is only one part of the actual definition. Now, so you don’t have google for anymore versions, I’ll make it simple for you:

In the real world, or at least in Schuylkill county, this is how things play out:

I punch you in the mouth causing minor bruising and/or swelling. That’s a summary Harassment.

I punch you in the face breaking your nose. That’s Simple Assault.

I punch you in the face several times breaking your nose, your jaw and subsequently knocking you to the ground causing you to fracture your skull. That’s Agg Assault.

Now you don’t have to like these real world definitions, but this is reality. Now knowing this, where does Plachko’s push fall into these categories??

  66. YES now we get to it… HERE IN SCHUYKILL COUNTY, IF your elected, and a Democrat… THEN you MUST have some sort of bruising.. Lets not get let the TRUE law get in the way of your Schuylkill County Elected Democrat version of the law.

Now Knowing this… Like your the Supreme Court of PA and now I must ACCEPT your inaccurate definitions.

    LOL

    YOUR a riot.

  67. From the PA Criminal Code for Simple assault

    1) attempts to cause or intentionally, knowingly or recklessly causes bodily injury to another.

What your trying to push off as law is, 18 Pa.C.S. § 2701(a)(1) which refers to bodily injury, and is accurate, how ever, I am not required inflict Bodily injury only ATTEMPT to cause.

I was looking for the Elected Schuylkill County Democrat exemption but could not find it.

    Thanks for playing though.

  68. Hey F

Please stop trying to play Lawyer on here. You are making the real ones who paid there dues and know the law, sick to their stomaches.

You “do not ” know the Law. Plachko should have been arrested, you know it and I know it, but because you are are Plachko lover or maybe “F” is really Plachko, Who knows??

Bottom line,,,you know that you or I would have been arrested for doing the same thing.

    You Lose……..get over it!!!

    To Taxpayer and “Hey F”:

I am not defending Plachko and I never said he shouldn’t be arrested for his actions. What I said was that he should be arrested for the same thing you or I would have been arrested for when doing the same thing, and that is Harassment.

And Taxpayer M, you said, “What your trying to push off as law is, 18 Pa.C.S. § 2701(a)(1) which refers to bodily injury, and is accurate, how ever, I am not required inflict Bodily injury only ATTEMPT to cause.”

I am not trying to “push off as law” my explanation of Harassment…it is the law. And that’s exactly what Plachko did…he shoved the guy or otherwise subjected him to physical contact.

Could he have been CHARGED with Simple Assault and Harassment? Yes, and I’ve said that previously, but the Simple Assault charge would have never gotten past the preliminary hearing stage. It would’ve been dropped given these circumstances, just like it would have been for you or I, and then he would only have had to deal with the summary Harassment charge.

Taxpayer M, I’m not sure what you’re not understanding, but I can’t be any clearer than that.

Hey F said, ” Please stop trying to play Lawyer on here. You are making the real ones who paid there dues and know the law, sick to their stomaches.”

By all means, tell me where I’m wrong and why. Judging by your response to me, there’s no possible way that YOU are an attorney, so go ask an attorney if what I’m saying is incorrect and then try put together a coherent response letting me know what they said.

And finally, I’m not Plachko, his friend, a lawyer, or a Democrat.

  71. You have proven you know nothing about the law. You seem to think that because you have spoken, that it is the law. Your wrong.

You have now changed from “A Simple Assault charge would never be supported unless there was bodily injury, and bruising and/or minor abrasions don’t count” to “Could he have been CHARGED with Simple Assault and Harassment? Yes”

My entire point is that Simple Assault done not require injury. And you have made it your personal mission to prove me wrong. You have only proven you have no idea what the law is, just “In the real world, or at least in Schuylkill county, this is how things play out” as if Pennsylvania Law definitions are different here. As if this is one spot in Pennsylvania that Simple assault requires injury. Get over yourself.

And again you resort to insults to get your point across.

If you were indeed a lawyer (and a democrat), you may be a good defense attorney, just say anything until a jury buys it because you try to show HOW smart you are and HOW smart they are not and only the F could possibly know the truth, because F says so.

But you would never EVER be a good Judge or Prosecutor, because you just do not have the truth or the facts on your side.

“I’m not sure what you’re not understanding, but I can’t be any clearer than that.” and “Now, so you don’t have Google for anymore versions” Like I am some 3rd Grader. You can take all of that and miniscule knowledge of the Pa Law up your nose.

Do not presume to know me, do not presume to pretend you are better than me, smarter than me. You do not know me, and honestly I do not care if your Plachko. It doesn’t matter who you are really, you still wrong.

What did you stay at a Holiday Inn Express last night or something? Geezzz..

  72. F

You said, “My entire point is that Simple Assault does not require injury.”

Not true…your original post called for Plachko to be in jail and more serious charges levied against him, did it not??

You said, “You have only proven you have no idea what the law is, just “In the real world, or at least in Schuylkill county, this is how things play out” as if Pennsylvania Law definitions are different here. As if this is one spot in Pennsylvania that Simple assault requires injury. Get over yourself.”

Also not true….I know the what the definitions say but I gave you the real world applications of the various levels of assault. And they’re applied that way in many counties, including here in Schuylkill county. Feel free to sit at one of the DJ’s offices some day and find out for yourself. If you don’t have the time, then ask any attorney, or any judge, or any cop friend of yours if what I am saying isn’t true.

Otherwise, we’ll just have to agree to disagree.

  73. Getting Better

Hey F,,,,Your posts are getting better. But one question?? If I would have done that, would they have put me in cuffs and taken me for a ride that night??? ( Had I done it to Plachko)

I know this,,,,,,as a juror,,,,he’s quilty. I also know this,,,,,,I spoke with the witnesses. He DID what he was accused of.

  74. U

    F
Now your just being a jerk.

    Give it up.

    U

  75. You know what, F, I refuse to spend another second of my life arguing with you.

We all know your wrong. Even you know it.

    FIN

  76. F

    “We all know your wrong.”

    Really?? Who’s “we all” ???

Go talk to somebody with knowledge of the judicial system. I think you’ll be surprised to find out who, exactly, is “wrong.”

  77. Hey F I got one!!

    Pine Grove Man Faces Charges

A 52-year-old Pine Grove man was aressted by state police at Jonestown and charged with simple assault and harrassment after an incident at Fisher Avenue and Micro Drive in Union Township Lebanon county, at 5 p.m.

Troopers said Clarence Tobin Jr. will have to answer to the charge in a Lebanon district court.

Troopers charge Tobin with grabbing, and hitting Gail Madenford, 45, of Jonestown, causing the woman to suffer some bruising.

  78. F Wait!!

I wasn’t being a jerk,, I mean’t we were getting somewhere. And my questions were legit.

    Too legit to quit.

  79. So

So if Plachko wasn’t wrong in what he did,,,,that means he was right??

The parent provoked it. But….Plachko cannot do what he did either. Do you agree!!

I say yet again,,,,the law states that you must remove yourself from the situation.

Let’s do it this way F…….If the Father did what he did and Plachko drove away, only to go to the end of the parking lot and call Police, what do you think would have happened???

  80. F

“A 52-year-old Pine Grove man was aressted by state police at Jonestown and charged with simple assault and harrassment after an incident at Fisher Avenue and Micro Drive in Union Township Lebanon county, at 5 p.m.

**As long as this wasn’t a domestic violence incident, this is a perfect scenario…follow this case and I guarantee he only pleads or is found guilty of Harassment. (Unless of course she decides that she still loves him and drops the charges all together!)

“Hey F,,,,Your posts are getting better. But one question?? If I would have done that, would they have put me in cuffs and taken me for a ride that night??? ( Had I done it to Plachko)”

**Tricky question only because of your scenario.. if you went after Plachko in his role as a ref, Assault on a Sports Official is a misdemeanor and would’ve had to have been witnessed by the police. If you went after him in his role as a judge, that’s Agg Assault and you go away in cuffs.

” So if Plachko wasn’t wrong in what he did,,,,that means he was right??
The parent provoked it. But….Plachko cannot do what he did either. Do you agree!!

**Read my previous posts, I’ve said that the whole time. Plachko was wrong, I absolutely agree with you. I’ve said over and over, Plachko could have been charged with both Simple and Harassment. But given the minor nature of the “assault,” only the Harassment would have stuck.

“I know this,,,,,,as a juror,,,,he’s quilty. I also know this,,,,,,I spoke with the witnesses. He DID what he was accused of.”

**And if the WV parent would’ve pursued it, Plachko probably would have been convicted of Harassment. The decision the WV parent had to make was whether pursuing it was worth a possible Disorderly Conduct conviction for himself.

  81. Ok

Agreed!! It’s long over. Just irritating sometimes.
